LICENSE AGREEMENT

McLean County Regional GIS Consortium Products and Services

IMPORTANT: Please carefully read the following Agreement before using any information or products. By using any products or services, you indicate your acceptance of the Licensing Agreement.

NO WARRANTY: Any and all information provided is "as is". There is no guarantee or warranty concerning the accuracy of information contained in the product. No warranty is made, either expressed or implied, as to any other matter whatsoever, including, without limitation, the condition of the product, or its fitness for any particular purpose. The burden for determining fitness for use lies entirely with the user.

LIMITATION OF LIABILITY: In no event shall any of the consortium or its member agencies have any liability whatsoever for payment of any consequential, incidental, indirect, special, or tort damages of any kind, including, but not limited to, any loss of profits arising out of use of or reliance on the product or arising out of the delivery, installation, operation, or user support.

PROTECTION OF PROPRIETARY RIGHTS:

A) Reproduction or redistribution of the information, or products derived there from, outside of licensee's organization or entity is expressly forbidden.

B) None of the information shall be electronically duplicated by any means for use by others, in whole or in part, without express written permission of the McLean County Regional Planning Commission.

C) If information is requested for use by a consultant on local government project; this shall only be used on the specified project for the requested unit of local government. Consultants may not further reproduce or redistribute the product beyond the scope of the specified project.

D) All files containing any source information or products derived there from shall be returned to Licensor upon project completion.

E) Resale of any products is prohibited.

CREDITS:

A) All products utilizing any of the information shall clearly indicate the source.

B) If the Licensee has modified the information in any way they are obligated to describe the types of modifications they have performed on the product/s.

C) Licensee specifically agrees not to misrepresent any information, nor to imply that changes they made were approved.
